PHOTOGRAPH DUPLICATION AND USE AGREEMENT

 

 

In my capacity as an employee or agent for ______________________________________

I request copies of the photographs listed below:

 

I understand and agree to the following conditions for the reproduction and use of

photographs from the Kheel Center for Labor-Management Documentation & Archives

(hereafter the Center)

 

1. That the Center will provide information concerning copyright ownership relative

to the items I have requested insofar as it is available to its staff. 

 

2.  That, unless otherwise informed in writing by Center staff, the works to be

duplicated at my request do not include formal copyright notice.  Copyright law may

protect this work or works.  Uses of this material may be allowed with permission

from the rights holder, or, if the copyright on the work has expired, or if the use

is "fair use" or within another exemption.  I understand I am responsible for

determining lawful uses of the material I have requested to be duplicated.

 

3. That any costs connected with the image or sound reproduction specified herein

relate to its physical reproduction, shipping and handling and do not constitute

license-to-publish fees.

 

4. That, as a condition of being allowed access to the requested photographs, my

organization agrees to indemnify the donor of the items, Cornell University, and/or

its agents and employees for any costs to them accruing consequential to my

organization's failure to obtain appropriate copyright permissions for use of the

photographs herein listed.

 

5. That this understanding covers one-time image use in print media only.  Any future

use will require a separate agreement.  Neither photo reprints nor digital files may

be retained by the user, designer or publisher for later use or for deposit with

another institution, nor may they be shared with other researchers. 

 

6.  That the image may not be cropped or altered in any way unless these changes are

specified in the image caption or credits.

 

7. That any publication will cite the UNITE Archives, Kheel Center, Cornell University,

Ithaca, NY 14853-3901 as the source.
